TERMS OF SERVICE

Please read these Terms of Service ("Terms") carefully before using the Brutal Weather mobile application ("App") operated by Samin Qureshi ("we," "us," or "our").

By downloading, installing, or using the App, you agree to be bound by these Terms. If you disagree with any part of the Terms, you may not access or use the App.

1. Use of the App

1.1 License

We grant you a limited, non-exclusive, non-transferable, revocable license to use the App for your personal, non-commercial use, subject to these Terms. This license does not include:

• Modifying, copying, or creating derivative works based on the App
• Reverse engineering, decompiling, or disassembling the App
• Removing any copyright or proprietary notices
• Transferring the App to another person or "mirroring" it on any other server

1.2 Eligibility

You must be at least 13 years old to use the App. By using the App, you represent and warrant that you meet this requirement and have the legal capacity to enter into these Terms.

1.3 Account Responsibility

You are responsible for:

• Maintaining the confidentiality of any account information
• All activities that occur under your use of the App
• Ensuring your device meets the minimum system requirements
• Complying with all applicable laws and regulations

2. Premium Subscriptions

2.1 Subscription Terms

Brutal Weather offers optional premium subscription plans ("Premium") that provide additional features such as:

• Ad-free experience
• Unlimited AI requests
• Access to all weather data sources
• Additional customization options

2.2 Billing and Renewal

Premium subscriptions are billed through the Apple App Store or Google Play Store, depending on your device. Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current period. You will be charged for renewal within 24 hours prior to the end of the current period.

2.3 Cancellation

You may cancel your subscription at any time through your device's subscription settings:

• iOS: Settings → Apple ID → Subscriptions
• Android: Play Store → Menu → Subscriptions

Cancellation takes effect at the end of the current billing period. You will continue to have access to Premium features until then.

2.4 Refunds

All purchases are final. Refunds are handled according to the policies of the Apple App Store or Google Play Store. We do not process refunds directly.

2.5 Price Changes

We reserve the right to modify subscription prices. Any price changes will take effect at the start of the next subscription period after notice is provided to you.

3. Weather Data and Accuracy

3.1 Data Sources

Weather data is provided by third-party services including OpenWeather, WeatherAPI, and AccuWeather. We aggregate and present this data but do not control its accuracy or availability.

3.2 Disclaimer of Accuracy

While we strive to provide accurate weather information, weather forecasting is inherently uncertain. You acknowledge that:

• Weather predictions may not always be accurate
• Actual conditions may differ from forecasts
• You should not rely solely on the App for critical weather-related decisions
• Always consult official weather warnings and emergency services when necessary

4. AI-Generated Content

4.1 Nature of AI Content

The App uses artificial intelligence (including Google Gemini) to generate weather commentary. This content is generated algorithmically and:

• Is for entertainment purposes as well as information
• May contain humor, sarcasm, or personality that some users find abrasive (especially in "Roast" mode)
• Should not be interpreted as professional meteorological advice

4.2 User Discretion

You can choose between "Roast" and "Reassure" modes, or disable AI commentary entirely. By using the AI features, you acknowledge that the content is generated automatically and may not always be to your taste.

5. Intellectual Property

5.1 Ownership

The App, including all content, features, and functionality, is owned by Brutal Weather and is protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.

5.2 Feedback

Any feedback, suggestions, or ideas you provide regarding the App may be used by us without restriction or compensation to you.

6. Prohibited Conduct

You agree not to:

• Use the App for any illegal purpose
• Attempt to gain unauthorized access to any part of the App
• Interfere with or disrupt the App or its servers
• Use automated systems to access the App without permission
• Remove or alter any proprietary notices
• Use the App to harass, abuse, or harm others

7. Termination

We may terminate or suspend your access to the App immediately, without prior notice or liability, for any reason, including if you breach these Terms. Upon termination, your right to use the App ceases immediately.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, BRUTAL WEATHER SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR USE, ARISING OUT OF OR RELATED TO YOUR USE OF THE APP.

IN NO EVENT SHALL OUR TOTAL LIABILITY EXCEED THE AMOUNT YOU PAID FOR THE APP IN THE LAST 12 MONTHS, OR $50 IF YOU HAVE NOT MADE ANY PURCHASES.

9. Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

WE DO NOT WARRANT THAT:

• The App will function uninterrupted, secure, or available at any particular time
• Any errors or defects will be corrected
• The App is free of viruses or other harmful components
• Weather data will be accurate or reliable

10. Indemnification

You agree to defend, indemnify, and hold harmless Samin Qureshi and Brutal Weather from and against any claims, liabilities, damages, losses, and expenses arising out of or related to your use of the App or violation of these Terms.

11. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Province of Ontario, Canada, and the federal laws of Canada applicable therein, without regard to its conflict of law provisions. You agree to submit to the personal and exclusive jurisdiction of the courts located in Ontario, Canada for any disputes arising from these Terms.

12. Changes to Terms

We reserve the right to modify these Terms at any time. Changes will be effective immediately upon posting the updated Terms in the App or on our website. Your continued use of the App after changes constitutes acceptance of the revised Terms.

13. Severability

If any provision of these Terms is held invalid or unenforceable, that provision will be modified to the minimum extent necessary to make it enforceable, and the remaining provisions will remain in full force and effect.

14. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Brutal Weather regarding the App, superseding any prior agreements.
